Terms of Service

1. Eligibility

You must be at least the age required under applicable law to use the Services. The Services are not directed to children under 13. By using the Services, you represent and warrant that you meet the legal age requirements and have the authority to agree to these Terms.

If you are using the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

You may not use the Services except as expressly permitted by these Terms and applicable law.

3. User Accounts and Platform Access

Certain features may require access through TikTok or another platform account. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account, to the extent permitted by applicable law and platform functionality.

We may rely on user, authentication, or account information provided through TikTok or other platform providers.

4. In-Game Items, Virtual Content, and Purchases

The Services may include virtual items, in-game currency, boosts, rewards, cosmetic items, or other digital content ("Virtual Items").

Unless otherwise required by law:

• Virtual Items are licensed, not sold.
• Virtual Items have no cash value.
• Virtual Items are non-transferable, non-refundable, and may not be redeemed for money or property.
• We may modify, suspend, discontinue, or reset Virtual Items, game balances, or features at any time.

If in-game purchases are made available, all purchases are subject to the applicable payment platform's terms and policies in addition to these Terms.

5. Acceptable Use

You agree not to:

• Violate any law, regulation, or third-party right.
• Cheat, exploit bugs, use unauthorized automation, bots, scripts, or mods.
• Reverse engineer, decompile, scrape, or attempt to extract source code except where prohibited by law from being restricted.
• Interfere with security, stability, or normal operation of the Services.
• Access accounts, data, or systems without authorization.
• Upload or transmit malware, harmful code, or malicious content.
• Use the Services for fraud, harassment, abuse, or any harmful or unlawful purpose.
• Infringe intellectual property or publicity/privacy rights.
• Exploit the Services for commercial resale or unauthorized distribution.

6. User Content and Feedback

If you submit feedback, suggestions, reviews, comments, bug reports, or other content to us ("Submissions"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and otherwise exploit such Submissions for any lawful purpose, without compensation to you, unless prohibited by law.

You represent that you have the necessary rights to provide any Submissions.

7. Intellectual Property

The Services, including all games, software, code, designs, text, graphics, audiovisual content, trademarks, logos, and other materials, are owned by or licensed to JAREDS HOLISTIC HERBS AND CRYSTALS LLC and are protected by intellectual property and other laws.

Except for the limited license expressly granted in these Terms, no rights are granted to you.

8. Service Availability and Changes

We may, at any time and without liability to you:

• Modify, update, suspend, or discontinue any part of the Services.
• Change features, content, availability, or technical requirements.
• Fix bugs, investigate abuse, or implement security measures.
• Restrict, suspend, or terminate access for any reason, including suspected violations of these Terms.

We do not guarantee that the Services will always be available, error-free, or uninterrupted.

9. Third-Party Services and Platforms

The Services may depend on or interact with third-party platforms and services, including TikTok. Your use of those third-party services may be subject to separate terms, policies, and technical limitations. We are not responsible for third-party services.

10. Privacy

Your use of the Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, AVAILABLE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAREDS HOLISTIC HERBS AND CRYSTALS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless JAREDS HOLISTIC HERBS AND CRYSTALS LLC and its affiliates, personnel, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to:

• Your use of the Services.
• Your violation of these Terms.
• Your violation of law or third-party rights.
• Your misuse of the Services or submitted content.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms, created risk for us or others, or where required for legal, technical, or business reasons.

Upon termination, the rights granted to you under these Terms will cease immediately.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Alabama, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Alabama, unless applicable law requires otherwise.

You and JAREDS HOLISTIC HERBS AND CRYSTALS LLC consent to personal jurisdiction and venue in those courts.

Optional lawyer review item: Many U.S. consumer internet products add an arbitration clause and class action waiver here. That can reduce litigation exposure, but it should be drafted by counsel for your target states and business model.

16. Changes to These Terms

We may revise these Terms from time to time. The updated version will be effective when posted, unless otherwise required by law. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.
